Terms & Conditions
Payments, Cancellations & Refunds:
The entire cost of the cruise is collected at time of booking. You may cancel up to 48 hours before scheduled departure time and receive a 100% refund of the entire amount of the trip. You may cancel within 48 hours but you will forfeit $300. If you do not cancel before your scheduled departure time there is no refund.
If inclement weather arises the captain will make the final decision prior to the sailing time. If the trip is cancelled due to inclement weather you can apply the amount paid to a future trip or get a full refund. Once we leave shore there are no refunds, even if the weather does subsequently turn bad.
A tip of 15-20% is customary for excellent service. Tips are not included in the price of the charter.
Tax:
The City of Chicago imposes an 8% "Personal Property Lease Transaction Tax" on all boat charters. This tax is collected at the time of booking.
Cancellation or changes to the charter by Dalia Charters:
If through circumstances beyond the control of Dalia Charters, a charter is cancelled then all deposits and fees will be refunded and the company's liability thereafter will cease. Dalia Charters shall not be held responsible for any additional costs incurred by the clients attending a charter that is subsequently cancelled, including but not limited to flights, care hire, transfers and accommodation.
Captain's Decisions:
In accordance with accepted maritime practice the decisions of the captain from the moment he steps on board the vessel are final. Every attempt will be made to give clients the maximum sea time available, if however the skipper deems that weather conditions, safety issue or any other consideration would make it imprudent to continue once the vessel has left the harbor, the captain’s decision is final. Dalia charters shall not be liable for any claims for return of fees due to such events.

Once we leave shore there are no refunds. As a general rule, we will not sail if the wave heights reported by the most recent National Weather Service Marine Forecast exceed 1-3 feet. The NWS Marine Forecast is updated every 6 hours, usually around 9:30 and 3:30.
Note that if the most recent NWS Marine Forecast shows a "Small Craft Advisory", "Storm Warning", "Gale Warning" or any other type of warning, we will not sail.
Any person arriving to the boat showing signs of being intoxicated or under the influence of drugs may not be allowed on board the boat to partake in the charter. Should this situation arise, Dalia Charters shall not be liable for any claims for return of fees due to such events.
We want everyone who sails with us to have a fun and memorable time. However, we ask that all guests keep their behavior appropriate at all times. If guests become unruly, intoxicated, or otherwise become a hazard to the safety of others on the vessel, the captain may, at his discretion, cancel the trip and return to port. In the event of this, there will be no refund issued.
Insurance:
The boat is insured for charter purposes, Dalia Charters accepts no liability for loss, personal injury, illness or food poisoning, we recommend that clients obtain their own insurance to cover these eventualities.
Dalia Charters accepts no responsibility for disruption caused to the client by force majeure such as fire, flood, acts of god, strikes, political unrest, acts of government or authorities, or any other occurrence beyond our control.
Damages and Breakages:
Damages and breakages caused by the client as a result of willful or neglectful act are the responsibility of the client and any costs incurred as a result of such, shall be reimbursed on demand to Dalia Charters or its representatives. For safety reasons the captain must be notified immediately of any damage found or caused by the client. You are renting a "barebones" charter, meaning that you are responsible for bringing aboard your own food, drink and entertainment. However, you are required to return the boat in the same condition that it was leased to you: cleaned and with no damage. If the boat requires a subsequent cleaning or there is damage (damage includes a clogged toilet), then we may bill your credit card to cover the costs. You explicitly authorize Dalia Charters to bill your card up to $3000 to cover any damages or cleaning.
Prohibited items and Substances:
It is forbidden to bring on board any illegal item such as prohibited drugs, firearms, weapons, noxious substances or liquids, or any other item of any kind that is unlawful or unsuitable for use on the boat. Firearms are explicitly prohibited. The captain reserves the right to refuse to allow any item on board that he should deem unsuitable for any reason whatsoever. Any client refusing to allow packages to be checked will not be allowed onboard the vessel and will be responsible for their own return travel arrangements. In the even a client refusing to have a package inspected chooses not to continue with the charter, the full cost of the charter will not be refunded. Dalia Charters will not be responsible for any costs incurred by the client as a result of such an event occurring.
Published Information:
Every care has been taken to ensure that all information published by Dalia Charters including brochures, advertisements and mailings, that describe the boats and activities are accurate and are given in good faith not withstanding that such are subject to change due to events beyond the control of Dalia Charters.
Declaration:
All charter clients must agree to these terms and conditions, the charterer must be over the age of 18 years, and all passengers in good health other than any conditions notified to us. The captain has the final decision in any matters concerning the safety of the vessel and any of its passengers.
Changes to our Terms and Conditions:
We may revise this terms and conditions at any time.
